Terms of Service
Last updated: 25 October 2026 · Version 2026-10-23
These terms are a contract between you and nybld. Please read them before using the service. By creating an account or using nybld, you agree to them.
1. Who we are
nybld is operated by nybld Limited, a company registered in England and Wales (company number 17399787), registered office 66 Paul Street, London EC2A 4NA ("nybld", "we", "us"). You can contact us at mail@nybld.com.
2. Who can use nybld
nybld is for business users aged 18 or over. By using it you confirm you are at least 18 and that you are using nybld for your business — running or building a shop selling digital art. If you are agreeing to these terms for a company, you confirm you have authority to bind it.
3. Your account
You sign in with a link sent to your email address, so keep access to that inbox secure — anyone who can open the link can reach your account. You are responsible for what happens under your account. One account per user; you may not share, sell or transfer it. Tell us at mail@nybld.com if you think someone else has gained access.
4. What nybld does
nybld helps you turn your own digital artwork into finished, publishable listings: it builds prompts for you to run in your own Midjourney account, and then upscales, crops, builds mockups and writes listing content for the images you choose, ready to send to your own store. It also composites your artwork into scenes made from your own rooms or from rooms it generates for you, finishes print-on-demand products in your Gelato account, and assembles sets of your pieces as gallery wall listings. For members, it also builds a Shopify store from your listings and transfers it to you (a turnkey store). nybld does not generate your artwork — you do that yourself, in your own Midjourney account.
The service runs on credits. What each plan costs, how many credits it includes, and what a credit does are set out on our plan and pricing pages; those pages are the authoritative source for prices and credit amounts, and we do not restate them here.
5. Plans, credits and payment
You can use nybld through a membership (a recurring subscription) or by buying credit bundles (a one-off purchase). Memberships renew automatically until you cancel; credit bundles do not renew. Payment is taken at checkout through Shopify.
Members can also buy a turnkey store (a one-off purchase): we build a Shopify store from your nybld listings in the design and palette you choose, connect your own domain, and transfer the store to your Shopify account. Two add-ons can be bought with it: a brand package (a logo and a brand kit) and an Etsy import (the listings you choose from your connected Etsy shop, with their download files). Your Shopify plan and its fees are yours. Once everything you bought is delivered, it is not refundable.
Before you pay, checkout states the price, whether the charge recurs and how often, how to cancel, and — for customers in the UK — your right to withdraw and what agreeing to immediate supply does to it. Your cancellation and refund rights are set out in our Refund & Cancellation Policy, which forms part of these terms. You can cancel a membership at any time, online, from the subscriptions in your customer account at nybld.com.
We may change membership prices. We will email you at least 30 days before a change applies to your membership, and you can cancel before it does.
6. Free trial
A new account starts with a free trial that takes no payment card and no subscription. The trial gives you a limited amount of use so you can try the service. We may set and change the limits of the trial, and we may withdraw or change the trial for new sign-ups at any time. We may also close accounts that abuse the trial (for example, by creating multiple accounts to avoid its limits).
7. Acceptable use
When you use nybld, you agree not to:
- upload or produce content you do not have the right to use, or that infringes anyone else’s intellectual property, or that is unlawful, or that depicts a real identifiable person without their consent;
- use nybld to create content that is illegal, or that breaches the rules of any platform you publish it to;
- ask Generate room for anything other than a room for your mockups, or for anything OpenAI’s usage policies do not allow;
- misrepresent your listings, or use nybld to mislead buyers;
- attempt to break, overload, reverse-engineer, scrape or gain unauthorised access to the service, or get around its limits, security or credit metering;
- use another person’s account, or let anyone else use yours;
- resell or white-label the service without our written agreement.
You are responsible for making sure your finished listings comply with the rules of the marketplaces you publish them to — including any requirement to disclose AI involvement and to attribute your work. nybld provides an optional AI-disclosure line you can switch on in your listing defaults; what you publish remains your responsibility.
If you break these rules we may suspend or close your account (see section 12).
8. Your content, and our platform
Your content stays yours. You keep all rights in the artwork you upload, the direction you give, and the finished listings nybld produces for you. We do not claim ownership of them.
To run the service, you give us a limited licence to store and process your content — to upscale it, crop it, build mockups, generate listing text, and deliver it to the accounts you connect — for as long as needed to provide nybld to you. This licence is only for running the service; we do not use your artwork to train AI models.
What you confirm about what you upload. For every file you add to nybld, you confirm that you own it or hold the licences and permissions needed to use it in the way you intend — including for commercial sale where you intend to sell it — and that our storing, processing and delivering it as described above will not infringe anyone else’s rights. This applies however the file was made, including by a generative AI tool, and whether you made it or someone else did, and it includes the listings and download files you give us for an Etsy import. We do not check the origin of your files and we cannot; that check is yours.
Material we will not process. We may refuse to process, or remove, material that breaches section 7, that we are required to remove, or that a platform we deliver to has told us it does not permit. Where it is reasonable to do so we will tell you which files are affected and why. Removing a file does not by itself close your account — section 12 covers that.
Our platform stays ours. nybld — the software, the interface, the mockup library we provide, and everything that makes up the service — belongs to us. Using nybld does not give you any rights in it beyond the right to use it under these terms. If you send us feedback or suggestions, we may use them without obligation to you.
The mockups are yours to sell with. Every scene in our mockup library is our own work. When your artwork is placed into one, the finished image is yours to use commercially without limit or further payment — publish it as product photography, advertise with it, and keep using it on listings that outlive your subscription. What you may not do is take the empty scenes themselves, or resell the library as mockups.
Rooms nybld generates for you. A room you generate is yours to use like any room in your account, and the mockups you make with it are yours to sell with on the same terms as above. We pass on to you every right we receive in it. The same or a similar room can be generated for someone else, so it is not exclusive to you, and we make no promise about whether copyright protects it.
Logos from the brand package. A logo we make for you starts from options made with a generative AI tool and is finished by hand. It is yours to use, and we pass on to you every right we receive in it. A similar design can be generated for someone else, so it may not be unique to you, and we make no promise about whether copyright protects it or whether it can be registered as a trade mark.
9. Third-party platforms
nybld works alongside services you have your own relationship with — Midjourney, Etsy, Shopify, Gelato and Google Drive among them. We are not affiliated with, endorsed by, or acting on behalf of any of them, and their names are used only to describe what nybld does.
Your Midjourney account, your Etsy shop, your Shopify store, your Gelato account and your Google Drive remain yours and are governed by those providers’ own terms, which you are responsible for following. nybld sends content to your connected accounts on your instruction; we are not responsible for those providers’ services, decisions or availability, including any decision they make about your account.
Etsy
The term ‘Etsy’ is a trademark of Etsy, Inc. This Application uses Etsy’s API, but is not endorsed or certified by Etsy.
THIS APPLICATION IS SOLELY PROVIDED BY NYBLD (THE “APPLICATION DEVELOPER”). YOU ACKNOWLEDGE THAT ETSY, INC. AND ITS AFFILIATES ARE NOT THE APPLICATION DEVELOPER, DO NOT PROVIDE THE APPLICATION SERVICE, AND MAKE NO WARRANTIES OF ANY KIND WITH RESPECT TO THE APPLICATION OR DATA ACCESSED THROUGH IT.
When you connect your Etsy shop to the nybld Listing Manager, nybld asks Etsy for only the access it needs to do its job: to create the draft listings you build, to read your shop’s listings so the manager can show them to you and copy the ones you choose into your turnkey store, to save the edits you make in the manager back to your own listings, and to read your shop’s section names so each listing files itself correctly. New listings are only ever created as drafts, which you review and publish on Etsy yourself. nybld never deletes a listing, and it does not ask for, and cannot, read your orders, your messages or your buyers’ information. In handling any data from your Etsy shop, nybld acts as your service provider and processes that data only to provide the features you use. nybld is the sole provider of the service and charges its own fees for it; Etsy charges nothing on our behalf.
Shopify
The term ‘Shopify’ is a trademark of Shopify Inc. This Application uses Shopify’s API, but is not endorsed or certified by Shopify.
nybld is solely responsible for the nybld application, including how it is built, distributed and supported and how it handles data from your Shopify store. Shopify is not the developer of the application, does not provide the service, is not liable for any fault in it or any harm that may result from it, and does not provide installation assistance for it. nybld connects to your store through an app you create and install in your own Shopify admin, and uses only the permission that app grants.
Your turnkey store. We build a turnkey store in a Shopify store we create for you, and transfer it to you. After the transfer we keep collaborator access to it for 30 days, to connect your domain and fix anything that needs it, and then remove that access; you can remove it sooner from your Shopify admin. That access does not include your customers or your orders.
10. Availability and changes to the service
We work to keep nybld available and working, but we do not guarantee it will be uninterrupted or error-free. Parts of the service may be in development or depend on a third party’s approval, and we may add, change, or remove features. Where a change materially reduces the service you are paying for, your cancellation and refund rights in the Refund & Cancellation Policy apply.
If we permanently withdraw the nybld application or its Etsy integration, we will give at least 30 days’ prior written notice to affected sellers and to Etsy.
11. Consumer rights, warranties and disclaimers
If you are a consumer (an individual acting outside your trade or business), you have statutory rights that these terms do not affect. In the UK, the Consumer Rights Act 2015 treats every contract to supply digital content as including terms that the content is of satisfactory quality, fit for any particular purpose you told us about, and as described, and a term of these terms is not binding on you to the extent it would exclude or restrict those rights. Nothing in these terms removes or limits those rights.
Subject to those rights, and to the extent the law allows, nybld is provided "as is" and we do not give other warranties — for example, we do not warrant that the service will meet every requirement you have, or that any listing it produces will rank, sell, or be accepted by a marketplace.
12. Suspension and termination
You can stop using nybld and close your account at any time. Cancelling a paid membership is covered by the Refund & Cancellation Policy.
We may suspend or close your account if you break these terms, misuse the service, or use it in a way that creates legal risk or harms other users or us. Where it is reasonable to do so, we will tell you why and, if the problem can be put right, give you a chance to do so. If we close your account, your right to use the service ends; the sections of these terms that by their nature should survive (such as content licences, disclaimers, and limitation of liability) continue to apply.
13. Our liability to you
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited or excluded under the law that applies to you — including, for consumers, the statutory rights in section 11.
Subject to that:
- We are not liable for loss that was not reasonably foreseeable, or for indirect or consequential loss.
- We are not liable for loss of profits, revenue, sales, data, goodwill, or business opportunity — for example, a marketplace removing your listings or suspending your shop.
- Our total liability to you for any claim connected with the service is limited to the amount you paid us for the service in the twelve months before the claim arose.
If you are using nybld for your business, you accept these limits as reasonable given what the service costs, and some of the protections in this section that the law reserves for consumers do not apply to you.
14. Your responsibility for your use
If you use nybld for your business, you agree to cover us for losses, claims and costs that arise from your breach of these terms or your misuse of the service — for example, a claim that content you produced with nybld infringes someone’s rights. This does not apply to consumers beyond what the law allows.
15. Changes to these terms
We may update these terms. If we make a significant change we will tell you — by email or in the app — before it takes effect. If you carry on using nybld after a change takes effect, you accept the updated terms. If you do not accept a change, you can stop using nybld and cancel.
16. Governing law and where you can bring a claim
These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction — except that, if you are a consumer, this does not deprive you of the protection of the mandatory consumer-law provisions of the country where you live, and you may bring a claim in the courts of your own country. If you are a business, the courts of England and Wales have exclusive jurisdiction.
17. Contact and support
Questions about these terms, and support with the service, go to mail@nybld.com. This inbox is monitored, and we aim to reply within two working days.
